Legal basis: § 93 (1) sentence 1 HGB
(1) Anyone who, on a commercial basis and without being permanently engaged to do so under a contractual relationship, undertakes for other persons the brokering of contracts for the purchase or sale of goods or securities, insurance, the carriage of goods, ship chartering or other objects of commercial trade has the rights and obligations of a commercial broker.
